Abstract

The Symbiotic Liability Trap — Complete Works consolidates seven papers into a unified structural thesis on cross-domain compliance failure in AI-assisted decision chains. The work demonstrates that current fault-based liability regimes — criminal, civil, and regulatory — presuppose that a breach of duty is cognitively recognisable to the responsible actor, yet this premise fails structurally wherever causal chains cross domain boundaries that no single expert can see across. The argument is formalised as a partition-refinement problem in epistemic logic and shown to hold for discrete boundaries and, a fortiori, for continuous gradients of declining cross-domain competence.

The volume is organised in seven modular components designed for independent peer review: Paper 7 establishes the doctrinal proof under German criminal law (§§ 17, 130 OWiG, § 324 StGB) with transpositions to US doctrines (Collective Knowledge, Responsible Corporate Officer, Willful Blindness). Paper 5 develops the strategic framework addressing the triangular liability gap between the EU AI Act (Art. 14), IED 2.0 (Directive EU 2024/1785), and the Environmental Criminal Law Directive (EU 2024/1203). Paper 6 documents the iterative human–AI discourse methodology through which the thesis emerged. Papers 1–4 provide empirical evidence from 2,983 indexed industrial cases: a selective ion-exchange analysis under IED 2.0, a forensic UPW system failure study (SEMI F63), a brownfield regulatory-drift case study, and a financial analysis of stranded-asset dynamics as a short position on environmental law.

The work proposes the Cross-domain Authority Artifact — a structured, machine- and human-readable integration architecture — as the structural remedy that converts invisible cross-domain risk into auditable accountability. The argument carries an inherent temporal duality (Janus Property): it operates as a structural defence before codification and as an aggravating standard thereafter, rendering itself obsolete as a shield by the act of publication.
